The amendment to the RES Act enters into force!

On July 19, the Seym passed an act amending the act on renewable energy sources and some other acts.Already today, on August 28, 14 days after being published in the Official Gazette, the Act enters into force!Now officially entrepreneurs will become prosumers.

On August 9, 2019, the President signed an amendment to the RES Act.On August 14, the act was officially entered in the Journal of Laws.Now, 14 days after entering the novel, it will enter into force.Now officially entrepreneurs are becoming prosumers.

Purpose of the amendment

The purpose of the Act is to implement additional actions aimed at achieving the goal of a 15% share of energy from renewable sources in gross final energy consumption by 2020. The proposed solutions are also intended to increase energy security.In the long term, the changes are to ensure constant access to energy for end users.What’s more, it is important to simultaneously keep energy prices as low as possible.

The amendment will allow conducting an auction for the purchase of electricity from renewable energy sources, which will be auctioned in 2019, by indicating in its transitional provisions its maximum quantities and values.According to the calculations of the Ministry of Energy, the total increase in RES electricity production from the auction in 2019 will be about 10 TWh.Together with the auctions from 2018, electricity production from the renewable energy auction is expected to be around 35 TWh.

The changes contained in the amendment clarify the provisions of the Act on renewable energy sources in the field of market instruments.They apply to auctions and tender procedures in line with the principles of open competition for all producers of electricity from RES, competing on equal terms.The Act also removes interpretation doubts.

The most important changes

From our point of view, the most important change is support for the development of prosumer electricity generation.Entrepreneurs who will produce electricity for their own needs will also become prosumers.The condition is that the generation of electricity by entrepreneurs is not the subject of their predominant economic activity.

Another significant change concerns the energy auction.New solutions give more time to build winning projects by extending the sale of first energy.The time was extended to 24 months from the closing day of the solar auction session and 33 months for onshore wind energy.

The amendment also modifies the so-calleddistance act.According to its provisions, building permits for new wind turbines issued before its entry into force remain valid until July 16, 2021. The new deadline is five years from the entry into force of the amendment, i.e. half of 2024.

The Act also enables the creation of cooperatives in rural communes and rural-urban areas.
